Supreme Court of New Jersey Affirms Garcia’s Eligibility to Run

May 8, 2013  |  By: Angelo J. Genova, Esq.

The Jersey Journal and NJ.com reported yesterday that Genova Burns attorneys were again successful in their representation of Hoboken Housing Director Carmelo Garcia in his bid to run for an Assembly seat in the 33rd District. The Supreme Court of New Jersey refused to hear an appeal to an appellate court decision. The Jersey Journal reported: “ The Appellate Court had overturned the decision of Superior Court Judge Peter Bariso, who ruled that Garcia is not eligible to run for the June 4, 2013 Democratic Party primaries because he leads an agency that receives federal funds. This latest ruling follows an appeal by five Hoboken residents who filed the lawsuit challenging Garcia's candidacy for the Assembly, claiming a conflict of interest. ‘We are pleased with the Supreme Court's affirmation of last week's appellate decision," said Garcia's attorney, Rajiv D. Parikh of Genova Burns, LLC. "I know Mr. Garcia is looking forward to addressing the issues and advocating for the people.’” Mr. Parikh, Counsel, and Partner Angelo J. Genova represented Mr. Garcia in this case, with support from Firm Associate Maria R. Fruci. For full article click here.
